Attorney Tang Jitian Sues Jiansanjiang Authorities

Lawyer Tang Jitian had 10 broken ribs after the Jiansanjiang Incident. On June 23, he sent a registered mail to the Heilongjiang Provincial Higher People’s Court describing his 16 days and nights in Jiansanjiang where he suffered illegal and inhuman torture. He also filed a lawsuit against Jiansanjiang Public Security Bureau demanding compensation and a public apology.

In his administrative complaint, Tang Jitian demanded punishment of Jiansanjiang public security management. He request that the 15-day illegal detention of the plaintiff be confirmed, as the defendant never delivered the detention order to the plaintiff. The complaint ordered the defendant to pay the plaintiff’s medical fees of 100,000 yuan. Also, the complaint ordered the defendant to apologize to the plaintiff via the national media.

Tang Jitian points out that he was commissioned by Shi Mengwen, on behalf of his illegally detained relative Shi Mengchang at the ‘legal education base’ in Jiansanjiang Public Security Bureau. He had visited the legal education base to deal with the case.

However, the negotiations were fruitless. He was then taken away from his hotel at around 8p.m. on April 21 by a group of people claiming to be police whom would not show their identification. During the detention, he had been repeatedly tortured and humiliated.

After returning to Beijing, several hospital examinations confirmed Tang Jitian suffered from at least 10 rib fractures, broken teeth, bruising on the chest and legs, aggravated shadow of the lung and lumbar spine tuberculosis.

Tang Jitian listed the laws the police violated –the Constitution, the Administrative Procedure Law, the Administrative Punishment Law and Security Administration Punishment Act.

Nanjing Southeast University Law Professor Zhang Zanning: “Why do they dare to be blatant? Our judicial authority has become the underworld. Rather than operating under the law, the judiciary system is operated in the manners of underworld.”

Zhang Zanning indicates that the Chinese law expressly prohibits torture, illegal restriction of personal freedom, and kidnapping. Those who violate these ought to be held liable for the crimes.

Zhang Zanning points out that Jiansanjiang police conducted more than just an administrative offense. They also violated criminal laws for which they are liable as well.

Tang Jitian: “For a long time, the police have considered their duties not as law enforcement, not as servants of the society, but as the tool of the officials or government.”

Tang Jitian says that in a place as militarized as Jiansanjiang, many people became police because of close relatives. They have no basic law training, let alone a concept of human rights.

In his letter addressed to Heilongjiang High Court, Tang Jitian stated, “Torture leads to injustice.” He described that for years, the legal education base in Heilongjiang has conducted detention of citizens for several months to years without any legal proceedings, formalities and paperwork. Included are Shi Mengchang, Yu Songjiang, Jiang Xinbo, and among others who adhere to their belief. This deprivation of liberty has violated Criminal Law Article 238. The legal education base is a typical and veritable crime base.”

Tang Jitian told NTD that since 1999, the Communist regime has continued to suppress Falun Gong practitioners, discredit them through propaganda, characterize them as hostile forces or enemies, and even attack them on all fronts.

Tang Jitian: “Some officials have committed crimes, even crimes against humanity. The so-called ‘judge’ will be judged. It is sure to change.”

Zhang Zanning points out that there has been no formal document or law officially banning Falun Gong. It is Jiang Zemin’s talk to Le Figaro in which he labeled Falun Gong as a cult. However, his words are not law.

Zhang Zanning: “Falun Gong is a belief. Our Constitution clearly stipulates that Chinese citizens have freedom of religion. The brutal repression of Falun Gong is itself unconstitutional. I believe sooner or later, Jiang Zemin will be liquidated for his violations.”

Tang Jitian says the regime has pushed the persecution of Falun Gong onto the entire Chinese population. However, the path to democracy and freedom cannot be blocked, and those offenders will be punished in the future.
